Has Amber Heard just launched a new legal offensive? A few weeks after being sentenced for defamation, just like Johnny Depp, the actress came out of silence in a vitriolic interview with Today. In it, Amber Heard explains maintaining “Each word” of his accusations of domestic violence against Johnny Depp: “Until my death I will stand by every word of my testimony”. By accusing her ex-husband once again, Amber Heard therefore takes the risk of a new trial. “This interview could be considered a new ‘publication’ under the law, which could trigger a third lawsuit”explained lawyer Nicole Haff, who works at Romano Law, at the DailyMail. In fact, in law “a person who repeats or republishes the defamation will be subject to the same liability as the publisher of the original defamatory material”.

“A defamatory statement is considered to be ‘published’ when it is communicated either intentionally, with genuine malice or reckless disregard, or negligently, to a person other than the person defamed, add the laws. The statement must also be reasonably understood by the recipient to be false.” Johnny Depp and his lawyers could therefore decide to sue Amber Heard again. But for the lawyer, this hypothesis is unlikely. “Ms. Heard’s lawyers have already said that she cannot pay the initial judgment”, she confided, recalling that the actress does not have the necessary funds to pay the 10 million euros in damages to which she was sentenced. Johnny Depp was sentenced to two million euros.

After this trial, Amber Heard spoke out with a serious accusation against Johnny Depp. According to the actress, the jurors were “influenced by excellent acting” of her former husband and social networks have had real consequences. “Even someone who is sure and certain that I deserve all these vitriolic attacks, and that I am lying, could not look me straight in the eye and tell me that I have been talked about fairly on social media”, she pointed out. For Amber Heard, some of Johnny Depp’s 38 witnesses would have even been “paid or had nothing to do” with the legal battle that the two former spouses were waging. “I don’t care what people think of me or what judgments are made about what happened in the privacy of my own home, during my marriage, behind closed doors”, she added.
