An increasingly inquisitive Ministry of the Economy? Bercy would have asked to have a look at the bank accounts of all French people a year ago, according to an investigation. Where will the State’s right of scrutiny end?

The news was revealed by Next Inpact media a few days ago. According to him, the Ministry of Economy and Finance made a request following the overhaul of the file listing the bank accounts of French people, the Ficoba. This file currently gathers the list of accounts (current, savings, etc.), but no information on the operations carried out by these accounts, nor on their balance.

But the Ministry of the Economy intends to change this. He would have requested to get a look at the operations of the French. This is what we learn by consulting a letter from the interministerial digital directorate (Dinum), which published its response in October 2021, i.e. a year ago.

The letter is public, but it went unnoticed, not having hitherto been picked up by the media. We see that the government would have requested access to account balances and transactionsaccording to the formulation that is used by the Dinum:

The FICOBA 3 project aims to integrate the balances of bank accounts and ultimately the transactions carried out on these bank accounts. This is a very significant functional evolution of FICOBA, going from a management of static reference data to a management of very sensitive dynamic data.»

And it is precisely this “sensitivity” of the information which allowed the Dinum to refuse the request of the Ministry of the Economy. The letter points that there have been no parliamentary debates on this subjector consultation of the National Commission for Computing and Liberties (CNIL).

An unnoticed request

Hence a refusal regarding the extent of the supervisory power of the Ministry of the Economy. It is significant that this request went unnoticed for almost a year. The department’s official objective is to fight fraud, but no communication has been made regarding this file. However, the Directorate General of Public Finances (DGFiP) played the appeasement card with our colleagues from Tech&Co, explaining:

It’s obvious that all necessary legal consultations will be carried out beforehand before a possible evolution of the legal framework which would itself, by definition, be the subject of a public debate at the time of the discussion of the law.»

However, the silence of parliamentarians is particularly deafening, and making such a request without communicating it to the French of course raises questions. Especially since the DGFip explains that it is “only” the balance of accounts, as well as the number of monthly transactions, which interest the ministry. While the Dinum speaks well in its letter of “transactions carried out on these bank accounts“. So what is it really? We will only know with the possible evolution of the project.
